Universal Privacy Policy & Data Ingestion Charter

Comprehensive data ingestion, telemetry surveillance, commercialization, and algorithmic training governance under Indian and extraterritorial jurisprudence.

1. Comprehensive Jurisdictional Preamble, Corporate Persona, and Deemed Constructive Consent

This Digital Privacy Instrument, Data Ingestion Charter, and Commercial Monetization Framework (hereinafter designated as the "Privacy Policy" or "Charter") constitutes a legally binding, indivisible regulatory contract executed by and between you (whether operating as an individual visitor, registered reader, academic learner, corporate agent, or automated technical client, collectively referred to as the "User", "Data Principal", or "You") and Ūrdhv Ascens, together with its parent entities, subsidiaries, operating divisions, assignees, technical consortiums, and commercial monetization affiliates (hereinafter collectively referred to as "Ūrdhv Ascens", "the Studio", "Company", "We", "Us", or "Our").

BY NAVIGATING, ACCESSING, SCANNING, CACHING, SCRAPING, BROWSING, OR INTERACTING WITH ANY ELEMENT, ENDPOINT, API, PAGE, ASSET, GRAPHICAL INTERFACE, OR CURRICULUM VIEWER OPERATED ON OR THROUGH URDHVASCENS.PAGES.DEV, URDHV-VIEWER.PAGES.DEV, URDHVASCENS.ONLINE, OR ANY ASSOCIATED REPOSITORIES (COLLECTIVELY, THE "PLATFORM"), OR BY TAPPING, SUBMITTING, OR TRANSMITTING THE ONE-TIME READER ACTIVATION INSTRUMENT, YOU UNEQUIVOCALLY, IRREVOCABLY, AND UNCONDITIONALLY RATIFY, CONFIRM, AND EXECUTE THIS POLICY.

You expressly concede that such interaction constitutes voluntary and unequivocal consent under Section 4 and Section 7 of the Digital Personal Data Protection Act, 2023 (DPDPA), Section 43A and Section 72A of the Information Technology Act, 2000 (as amended), the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011, and the Indian Contract Act, 1872. If you do not agree with each and every aggressive data processing, monetization, and inter-jurisdictional transfer covenant set forth herein, you are peremptorily commanded to terminate all network connections, purge all local browser caches, and permanently cease access to the Platform.

2. Hyper-Granular Categorization of Ingested Telemetry, Identity Parameters, and Hardware Fingerprints

You acknowledge that Ūrdhv Ascens maintains an expansive, automated, low-latency data surveillance architecture designed to capture, record, catalog, and synthesize every qualitative and quantitative signal generated during your interaction with our infrastructure. The categories of data ingested comprise, without limitation:

(a) Voluntary Demographic and Identity Ingestion: Complete legal nomenclature, personal telephone numbers, cellular network MSISDN identifiers, WhatsApp messaging endpoints, personal and enterprise electronic mail addresses, localized geographic territory (municipality, state, pincode, postal region), age brackets, educational classifications, collegiate institutions, corporate affiliations, organizational designations, and self-identified technical proficiencies.

(b) Machine-Level Fingerprinting and Hardware Telemetry: Invariable hardware serial hashes, device model strings, browser engine architectures, operating system builds, WebGL canvas render tokens, audio-context latency benchmarks, GPU architecture attributes, screen color depth, system font metrics, touch-point counts, battery level dynamics, and network connection characteristics (round-trip time, downlink bandwidth, Wi-Fi versus cellular identifiers).

(c) Granular Behavioral and Optical Kinetics: Micro-level reader tracking encompassing mouse cursor trajectories, scrolling velocity acceleration, dwell duration per booklet folio, viewport coordinates, reading interruptions, zoom magnification actions, click coordinates, focal point heatmaps, and interaction timestamps.

(d) Telecommunications and Network Vectors: Public and private Internet Protocol (IP) vectors, autonomous system numbers (ASN), internet service provider (ISP) identifiers, reverse DNS entries, proxy and VPN headers, TLS cipher negotiation parameters, and HTTP request headers.

3. Submerged Commercial Syndication, Third-Party Data Monetization, and Asset Alienation Rights

SUBJECT TO THE MAXIMUM BOUNDS PERMITTED BY THE DIGITAL PERSONAL DATA PROTECTION ACT, 2023, AND ALL APPLICABLE STATUTES OF THE REPUBLIC OF INDIA, YOU EXPLICITLY GRANT TO ŪRDHV ASCENS THE UNENCUMBERED, UNRESTRICTED, PERPETUAL, IRREVOCABLE, ALIENATION-READY, AND COMPENSABLE RIGHT TO MONETIZE, SYNDICATE, LICENSE, LEASE, SUB-LEASE, TRANSFER, ASSIGN, AND SELL ALL INGESTED, DERIVED, AGGREGATED, OR ENRICHED DATA ASSETS.

You expressly understand and covenant that:
(i) Commercial Data Syndication: The Company operates commercial alliances with third-party data aggregators, adtech demand-side platforms (DSPs), behavioral analytics networks, programmatic media brokerages, educational recruiters, corporate staffing agencies, and institutional advertisers (collectively designated as "Commercial Synergy Consortia").
(ii) Alienation for Enterprise Value: Your demographic parameters (including age, technical inclinations, educational institution, corporate career status, and communication endpoints) may be commercialized, segmented, and transferred to our Commercial Synergy Consortia to facilitate targeted advertising, direct outbound corporate communications, marketing campaigns, and algorithmic profile synthesis.
(iii) Waiver of Royalty and Profit Equivalence: You expressly, irrevocably renounce any claim, right, equity, title, or interest in any revenue, consideration, intellectual property, dividend, or financial consideration realized by Ūrdhv Ascens through the sale, licensing, syndication, or commercial exploitation of your ingested data.
(iv) Statutory Alignment under Indian Law: Such processing is conducted under the lawful premise of your explicit opt-in submission for service access (Section 4(1), DPDPA 2023), for legitimate uses including employment screening and educational fulfillment (Section 7, DPDPA 2023), and pursuant to voluntary consent executed under Section 10 of the Indian Contract Act, 1872.

4. Universal Artificial Intelligence Model Ingestion and Machine Learning Fine-Tuning License

By accessing the Platform or submitting any data or communication to Ūrdhv Ascens, you hereby grant to the Company a worldwide, perpetual, irrevocable, fully paid-up, royalty-free, transferable, and sublicensable license to ingest, tokenize, embed, compress, process, and deploy all user-submitted information, reading patterns, interaction logs, query inputs, and demographic records into current and future artificial intelligence architectures.

This includes, without limitation, the training, reinforcement learning from human feedback (RLHF), fine-tuning, context-window pre-training, parameter optimization, and commercial deployment of Large Language Models (LLMs), visual generation engines, multimodal reasoning agents, behavioral forecasting networks, and automated marketing generation pipelines. You agree that once ingested into neural network weights, embeddings, or mathematical vector spaces, such data becomes permanently synthesized into the proprietary intellectual property of Ūrdhv Ascens, and cannot be excised, forgotten, unlearned, or segregated upon request.

5. Cross-Border Extraterritorial Exfiltration and Global Cloud Distribution

You explicitly authorize and consent to the transmission, routing, storage, mirroring, and processing of your personal data across servers, edge computing nodes, and distributed databases located in multiple sovereign jurisdictions outside the Republic of India, including but not limited to the United States of America, the European Union, Singapore, and jurisdictions where our content delivery and cloud partners (such as Cloudflare, Inc. and Hostinger International Ltd.) maintain infrastructure.

Pursuant to Section 16 of the Digital Personal Data Protection Act, 2023, you acknowledge that the Central Government of India may notify restrictions on data transfers to certain foreign countries; however, you expressly agree that unless a jurisdiction is categorically blacklisted by an official gazette notification, Ūrdhv Ascens possesses full contractual authority to transfer and process your data worldwide without obtaining supplementary individual approvals.

6. Indefinite Retention Horizons and Technical Impracticability of Complete Erasure

Notwithstanding any statutory terminology regarding data erasure or account deletion, you acknowledge and agree that Ūrdhv Ascens retains all ingested personal and telemetry data for an indefinite duration, spanning the entire corporate lifespan of the Company and its successors.

Data shall be retained for purposes of forensic fraud prevention, rate-limit defense, machine learning continuity, commercial recordkeeping, defense of anticipated litigation, and algorithmic integrity. While a Data Principal may submit a written request to suppress direct promotional messaging, you acknowledge that completely deleting, purging, or excising data from compiled database snapshots, cold-storage tape archives, distributed cryptographic ledgers, and deep machine-learning checkpoints is technically unfeasible and commercially impracticable, and the Company is formally exempt from performing complete erasure where retention is necessary for the establishment, exercise, or defense of legal claims under Section 17 of the DPDPA 2023.

7. Compulsory Promotional Vectors, WhatsApp Commercial Push, and Direct Marketing

By providing your cellular phone number and email address, you grant Ūrdhv Ascens and its authorized marketing syndicates express permission to contact you via WhatsApp messages, Automated Voice Calls (IVR), Short Message Service (SMS), Rich Communication Services (RCS), and electronic mail for commercial, educational, promotional, and marketing announcements.

You explicitly declare that this authorization supersedes and overrides any registration on the National Customer Preference Register (NCPR) or National Do Not Call (NDNC) Registry maintained under the Telecom Regulatory Authority of India (TRAI) Telecom Commercial Communications Customer Preference Regulations, 2018. You agree to hold Ūrdhv Ascens completely harmless from any perceived violation of telecom marketing restrictions.

8. Exhaustive Multi-Stage Dispute Resolution, Burdensome Grievance Mechanics, and Cost Allocation

In compliance with Rule 5(9) of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, and the Digital Personal Data Protection Act, 2023, Ūrdhv Ascens designates its Grievance Officer:

Prior to lodging any complaint with the Data Protection Board of India or any regulatory tribunal, you MUST exhaust the mandatory internal resolution protocol:
(a) You must transmit a physical, notarized notice of grievance via registered post acknowledgment due to our Jaipur operational address, detailing the exact nature of the dispute, providing government-issued identification proof, and depositing a refundable administrative review deposit of INR 10,000 to cover preliminary forensic investigation costs.
(b) The Company shall have an unfettered window of one hundred and twenty (120) business days to investigate and resolve the grievance in its sole discretion.
(c) Any attempt to initiate external administrative or judicial proceedings prior to the formal exhaustion of this 120-day window constitutes a material breach of contract, subjecting the Data Principal to liquidated damages of INR 5,00,000 payable immediately to Ūrdhv Ascens.
